— End-User License Agreement —

This license is an agreement between Silvas Digital (us) and any users (potentially you) of Silvas Digital’s digital snowglobe software (the/this software). The license states both how the software can permissibly be used and also how it must not be used. The license also declares an agreement on the lack of practical warrantability of software in general and the potential risks of using such software.

Permitted Uses

As a licensed user, provided that the activity is not restricted elsewhere in this agreement or by governing law, you MAY . . .

• Install, run, and use the software in any of its officially documented or obviously intended capacities.
• Copy, store, and use the software on multiple machines, simultaneously.

Prohibited Uses

License or otherwise, unless required to do so by governing law, you must NOT . . .

• Install, run, or use the software on or connected to any machine where the failure of that machine, damage to that machine, the failure of any other software running on that machine, or the loss of data stored on that machine, etcetera, is unacceptable (e.g., keep this software away from nuclear and weapons control systems, air traffic control systems, life-support systems, and the like).

Additionally, for globes purchased as personalizations or in personal price packages, you must NOT . . .

• Use this software but for personal and non-commercial purposes, and you may only do that if you are a member of the user group this software was personalized for.
• Distribute this software or allow this software to be distributed outside of the user group it was personalized for.

Potential Risks of Usage and Absence of Warranty

Due to the complex and interdependent nature of software, this software, like most, cannot be guaranteed to operate without flaw or undesired effects—despite the efforts of its creators—which could possibly lead to, among other things, loss of data or other property. This software is therefore provided “as is”, with no warranty of any kind (except where governing law does not allow for such warranty omission, in which case the software is provided with the weakest available legal warranty). If you decide to use the software, you must do so entirely at your own risk, releasing from liability us and anyone applicably connected to the software.

Photosensitive Epilepsy Warning

A fractional percentage of the population may experience seizures and/or other undesirable symptoms when exposed to certain visual stimuli such as flickering, rapid image alternation, and certain visual patterns.

Silvas Digital advises users to educate themselves further on photosensitive epilepsy and, should they decide to use this software, use it with caution for the safety of both themselves and those who may be nearby.
